These Terms and Conditions ("Terms", "T&C") constitute a legally binding agreement between Swiss Trade Funding, a company registered in Switzerland ("Swiss Trade Funding", "we", "our", "the Company"), and any natural or legal person ("Trader", "User", "Client", "you") accessing or using our services.
By accessing our website or purchasing any service on https://swisstradefunding.com (the "Platform", "Site"), you confirm that you have read, understood, and accepted these Terms.
If you do not agree with any provision, you must immediately discontinue use of the Services.
1. Definitions
For the purposes of these Terms:
- "Platform" refers to the Swiss Trade Funding website, its subdomains, associated services, and user interface.
- "Simulated Trading Environment" refers to a fully virtual trading environment using market data simulations, with no execution on live financial markets.
- "Simulated Account" refers to a virtual trading account operated exclusively within the Simulated Trading Environment. No real funds are deposited, invested, or traded.
- "Advanced Simulated Account" refers to a Simulated Account with extended parameters granted to traders who meet specific program conditions or select an accelerated access program.
- "Evaluation Program" refers to any structured program designed to assess trading behavior, discipline, and risk management within a Simulated Trading Environment.
- "Performance-Based Reward" refers to a discretionary commercial reward that may be granted by the Company based on simulated trading performance, subject to verification, eligibility, and internal review. These rewards do not represent profits generated on real financial markets.
- "Services" refer to all programs, Simulated Accounts, tools, interfaces, dashboards, and information provided by Swiss Trade Funding.
- "Restricted Jurisdictions" refer to countries or regions where access to the Services is prohibited due to legal, regulatory, or international sanctions.
- "User Data" refers to personal data provided during registration, payment, identity verification, or use of the Services.
2. Nature of the Services (Essential Clause)
Swiss Trade Funding provides exclusively:
- Access to Simulated Trading Environments
- Virtual trading accounts
- Performance evaluation and skill-based assessment programs
- Commercial rewards based solely on simulated performance
⚠️ IMPORTANT NOTICE
Swiss Trade Funding does NOT:
- Provide real trading accounts
- Accept or hold client funds for investment
- Execute trades on live financial markets
- Offer investment advice or portfolio management
- Provide regulated financial services under FINMA or any other financial authority
All Services are strictly non-investment, non-custodial, and simulation-based.
3. Eligibility
To access the Services, you must:
- Be at least 18 years old
- Have full legal capacity to enter into contracts
- Not be a citizen or resident of a Restricted Jurisdiction
- Not be subject to financial sanctions or trading prohibitions
- Comply with the laws applicable in your country of residence
Swiss Trade Funding reserves the right to request identity verification documents (KYC) at any time.
4. Account Creation & Responsibility
By creating an account, you represent and warrant that:
- All information provided is accurate, complete, and up to date
- You are responsible for maintaining the confidentiality of your login credentials
- All activities conducted through your account are deemed to be performed by you
The Company may suspend or terminate an account in case of fraud, rule violations, multiple account usage, or suspected unlawful activity.
5. Ownership & Use of Simulated Accounts
All Simulated Accounts, credentials, data, software, and tools remain the exclusive property of Swiss Trade Funding.
You are granted a limited, non-transferable, revocable license to access and use the Services in accordance with these Terms.
You are strictly prohibited from:
- Selling, sharing, or transferring access
- Using the Services for unauthorized commercial purposes
- Using prohibited automated systems, bots, or third-party tools
- Circumventing platform rules or controls
6. Program Structure & Access
The purpose of all programs is to evaluate trading behavior, discipline, and risk management within a Simulated Trading Environment.
Access to an Advanced Simulated Account is discretionary and may be granted or refused at the sole discretion of the Company based on rule compliance and eligibility criteria.
All trading rules, risk limits, and program conditions published on the Platform form an integral part of these Terms.
7. Fees, Payments & Rewards
7.1 Access Fees
All fees paid by the Client represent service access fees for participation in a simulated trading program.
Access fees:
- Are not deposits
- Are not investments
- Do not represent refundable balances
Unless otherwise stated, access fees are non-refundable once the Service has been activated.
7.2 Refund Policy
Refunds may be granted only in the event of a proven technical failure that prevents access to the Services.
No refunds will be issued in cases of:
- Rule violations
- Poor performance
- Voluntary abandonment
- Account termination due to non-compliance
7.3 Performance-Based Rewards
Performance-Based Rewards, if granted, are discretionary commercial payments issued by Swiss Trade Funding.
Such rewards:
- Are not investment returns
- Are not profits generated on real financial markets
- Do not represent client-owned funds
- Are conditional and non-guaranteed
Eligibility is subject to:
- Full compliance with all trading rules
- Consistency and risk analysis
- Identity verification (KYC)
- Anti-fraud and integrity checks
- Internal approval by the Company
The Company reserves the right to delay, reduce, refuse, or cancel any reward request at its sole discretion.
8. Prohibited Activities
The following activities are strictly prohibited:
- Use of unauthorized Expert Advisors (EAs), bots, or HFT systems
- Latency arbitrage, tick manipulation, or system abuse
- Multi-accounting or coordinated trading
- Copy trading or signal replication
- Use of VPNs to mask location
- Account sharing or outsourced trading
Any violation may result in immediate termination and loss of eligibility for rewards.
9. Limitation of Liability
Swiss Trade Funding makes no guarantees regarding trading outcomes or rewards.
The Company is not liable for:
- Simulated losses
- Technical outages or platform unavailability
- Data feed or API errors
- Trader decisions or human errors
- Third-party service disruptions
The Company's total liability is strictly limited to the amount of access fees paid by the Client.
Under no circumstances shall any simulated balance or displayed performance be considered real funds.
10. Data Protection & Privacy
Swiss Trade Funding processes personal data in accordance with:
- The Swiss Federal Act on Data Protection (FADP)
- The General Data Protection Regulation (GDPR), where applicable
Data is collected solely for service operation, compliance, and security purposes. No personal data is sold or transferred without authorization.
11. Intellectual Property
All content, trademarks, logos, software, and materials provided by Swiss Trade Funding are protected by Swiss and international intellectual property laws.
Any unauthorized reproduction or use is strictly prohibited.
12. Suspension & Termination
Swiss Trade Funding may suspend or terminate Services without prior notice in case of:
- Rule violations
- Fraud or suspected abuse
- Non-compliant use of the Platform
- Disrespectful or abusive behavior
13. Amendments
The Company reserves the right to modify these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by Swiss law.
Any dispute shall be resolved through arbitration in Switzerland, in English or French.
If any provision is deemed invalid, the remaining provisions shall remain in full force.
